Commercial/Residential:U.S. Taxation of Real Estate Transactions for Non-U.S. Sellers (FIRPTA Withholding Tax Issues) with Michael Brooks

Description

1) Non-US sellers of US real estate are subject to a 15% (of the gross sales price) IRS withholding tax (escrow will impose this).  This IRS withholding tax is refundable and can occasionally even be avoided.  Understanding how the IRS non-US seller withholding tax works is very important for a Realtor attempting to build an international client base. 

2) Non-US sellers will need to obtain a US Individual Taxpayer Identification Number (an "ITIN").  The IRS will only issue ITIN's under certain limited circumstances. Understanding how and when a non-US person can obtain an ITIN is also very important in building and maintaining an international client base.    

3) Working with an escrow company who understands and works regularly with international sellers is critical to maintaining and growing a happy international client base.  

Tax attorney Michael W. Brooks (of DIRECTS) will review and educate on the general rules of international tax withholding, plus he will provide an update on today's IRS (which currently has 30% fewer employees than it did in 2024).
